Practice Areas and Experience

Carrie A. Kercsmar has been practicing law since 2001. Carrie’s primary areas of practice include commercial litigation, construction and construction defect litigation, contract disputes, real estate and collections. As a litigator, Carrie has represented clients at trial, arbitration, mediation, settlement conference, and in disputes before the Arizona Registrar of Contractors.

Representative Cases and Clients

  • Represented one of Arizona’s largest single-family residential homebuilders in a two week trial involving construction and construction defect issues.

  • Represented four of Arizona’s largest single-family residential homebuilders in numerous construction defect cases, including class actions.

  • Represented a leading ice cream and dessert franchiser against terminated franchisees.

  • Represented a leading integrated data center service provider against terminated lessees.

  • Represented an employee against former employer for breach of employment contract, using a new and innovative approach to interpreting current employment statutes and breach of contract laws.

  • Obtained a favorable arbitration award on behalf of a trucking company accused of negligence.

  • Represented homebuilders and individual homeowners against contractors and home builders at the Registrar of Contractors as well as state court litigation.

  • Represented a franchisee against its franchisor for breach of contract and fraud claims.

Community Involvement

As an active member of the Arizona legal community, Carrie is a leader in many organizations. She was appointed to the Professionalism Committee of the State Bar of Arizona in 2007 and is currently the 2014-15 Chair, after serving as Vice Chair in 2013-14. She is a past President of the Arizona Women’s Lawyers Association, Maricopa Chapter, and a former board member for the Maricopa County Bar Association Young Lawyers’ Division. Carrie was the 2005, 2006 and 2007 Chairperson of the Maricopa County Bar Association’s “Law Week,” an annual week of charity events sponsored by the MCBA. In addition, she chaired the Judicial Appointments Committee for the Arizona Women’s Lawyers Association from 2006-2008. She has also volunteered in numerous other community legal programs such as the Volunteer Lawyers Program, Wills for Heroes, the State Bar of Arizona’s Mentor Program and the Maricopa County Superior Court’s Student Courthouse Experience. 

Carrie is a member of the Scottsdale Chamber of Commerce, the Scottsdale Bar Association, the American Bar Association and the Maricopa County Bar Association.

Personal

Carrie is from Fargo, North Dakota and moved to Arizona in 1987. She and her husband both practice law and work together. When not working, she enjoys spending time with their children and traveling.
