Practice Areas and Experience
Having joined Geoffrey Kercsmar’s practice way back in 2008, Eric Hull represents clients in business litigation, intellectual property matters, and small entertainment transactional matters. Licensed in both California and Arizona, Eric oversees Kercsmar & O’Hara’s Los Angeles operations while also maintaining his practice in Arizona. In over 15 years of practice, Eric has represented clients in all phases of the litigation process, including as lead counsel at trial and arbitration. He has extensive experience in contract disputes, corporate governance disputes, the dissolution of a businesses or separation of a partnership, and issues involving secondary liability such as vicarious liability or aiding and abetting. His intellectual property practice focuses on the prosecution and defense of false advertising claims under the federal Lanham Act and common law unfair competition. He has prosecuted several claims under the growing area of Internet defamation law.
Recognized for his writing, Eric takes pride in composing winning legal briefs. He has presented seminars to lawyers on crafting the facts of a case into relatable, persuasive narratives in court briefs and framing issues for maximum impact in front of juries.
In addition, Eric has a passion for independent film. He works with independent productions to assist with entity formation and production-related contracts and documents.
Eric previously practiced in the commercial litigation and class actions groups at Bryan Cave LLP (now Bryan Cave Leighton Paisner LLP) one of the largest firms in the United States.
Representative Cases and Clients
Obtained summary judgment for defendant in patent invalidity claim and co-authored the successful appellate brief in front of the Federal Circuit
Represented two Arizona corporations in successful action to remove a director from the board for self-dealing and fraud
Represented a leading dietary supplement company in its claims against a competitor for false advertising under the Lanham Act
Won motion to dismiss on Americans with Disabilities Act claim against healthcare provider
Obtained the involuntary dismissal of a consumer fraud class action in an arbitration forum, later confirmed in federal court
Participated in the research and drafting of a post-trial motion that resulted in the Maricopa County Superior Court overturning a $35 million punitive damages jury verdict
Assisted one of the world’s leading makers of musical instruments in responding to a FTC subpoena alleging anticompetitive practices

Personal
Eric was born and raised in Bettendorf, Iowa. He has a certificate in Screenwriting from the UCLA School of Theater, Film & Television and watches far too many movies each year. He is an avid fan of all Notre Dame athletics, hikes the trails of Southern California each weekend, and has a spoiled rescue terrier mutt.
